These Terms and Conditions apply to all websites, blogs, social-media accounts, social-networking profiles, channels, digital publications, online services and other digital platforms managed, maintained, operated, administered, controlled or published by or on behalf of GK Dutta alias Gopika Kanta Dutta.

These Terms and Conditions apply to all websites, blogs, social-media accounts, social-networking profiles, channels, applications, digital publications, online services, communication platforms and other digital platforms managed, maintained, operated, administered, controlled or published by or on behalf of GK Dutta alias Gopika Kanta Dutta.
For the purposes of these Terms and Conditions, all such websites, blogs, social-media accounts, profiles, pages, channels, digital services and related online properties are collectively referred to as the “Platforms”.
These Terms and Conditions apply to all officially associated and verified digital platforms of GK Dutta, including platforms created, maintained, administered, operated or managed by Mr. Gopika Kanta Dutta (GK Dutta) and/or persons or entities authorised to act on his behalf, including his team, licensees, affiliates, subsidiaries, group companies, officers, directors, agents, representatives, employees, contractors and authorised administrators, where applicable.
For the purposes of these Terms and Conditions, the expression “verified”, when used in relation to a GK Dutta digital platform, refers to a platform that has been officially created, maintained, operated, administered, authorised or otherwise recognised by GK Dutta or by persons authorised to act on his behalf.
All activities conducted through or in connection with the Platforms are subject to these Terms and Conditions and any additional policies, notices, rules, guidelines or conditions published on the relevant Platform.
The name “GK Dutta”, hereinafter referred to in these Terms as the “GK Dutta Brand”, is associated with and owned by Mr. Gopika Kanta Dutta, resident of Sripur, Huplong Cherra, Dharmanagar, North Tripura, Tripura, India.
Definitions
“You”, “Your”, “User” or “Users” means any natural person, legal person, organisation, institution or other entity that accesses, visits, views, interacts with, communicates through, contributes to or otherwise uses any of the Platforms.
“We”, “Us”, “Our”, “GK Dutta” or “GK Dutta Platform” means Mr. Gopika Kanta Dutta and, where applicable, persons authorised to act on his behalf, including his licensees, affiliates, subsidiaries, group companies, officers, directors, agents, representatives, employees, contractors and authorised administrators.
“Content” includes, without limitation, text, articles, documents, photographs, graphics, logos, trademarks, illustrations, audio, video, audiovisual material, designs, software, code, publications, comments, posts, notices, reports, information and other materials made available through the Platforms.
“User Content” means any text, image, photograph, audio, video, audiovisual material, comment, communication, document or other material submitted, uploaded, posted, transmitted or otherwise provided by a User through any Platform.
Introduction
These Terms and Conditions govern your access to and use of the Platforms.
By accessing, browsing, visiting, registering with, communicating through, submitting material to or otherwise using any Platform, you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions and any applicable policies referred to herein.
These Terms and Conditions apply irrespective of whether access is obtained through a computer, mobile phone, tablet, application, social-media platform, web browser, electronic communication system or any other device or technology.
Age Requirement
You must be at least 18 years of age to use the Platforms, unless a particular Platform expressly permits access or participation by persons below 18 in accordance with applicable law and the relevant Platform's rules.
Where you use a Platform subject to these Terms and Conditions, you represent and warrant that you are legally capable of agreeing to these Terms and Conditions.

- Display or reproduce Platform Content publicly for unauthorised purposes;
- Reproduce, duplicate, copy or otherwise exploit Platform Content for commercial purposes;
- Edit, alter, modify, adapt or create derivative versions of Platform Content;
- Redistribute Platform Content except where the relevant Content has been specifically and expressly made available for redistribution;
- Remove copyright, trademark, ownership, attribution, legal or other proprietary notices;
- Represent GK Dutta or any Platform as your own;
- Use GK Dutta's name, identity, branding, logos or Content in a manner that suggests unauthorised affiliation, endorsement or sponsorship.
Where Content is specifically made available for redistribution, such redistribution shall be subject to any conditions accompanying that Content.
Acceptable Use
You must not use any Platform in a manner that causes, or may cause, damage to the Platform or impairment of its availability, security, integrity or accessibility.
You must not use any Platform:
- For any unlawful, illegal, fraudulent, deceptive, abusive, harmful or malicious purpose;

You must not conduct systematic or automated data- collection activities, including but not limited to scraping, data mining, data extraction, data harvesting or automated copying, in relation to any Platform without the express written consent of GK Dutta.
You must not use any Platform to transmit or send unsolicited commercial communications.
You must not use any Platform for marketing, advertising, promotional or commercial purposes without the express written consent of GK Dutta, except where such use is expressly permitted by the relevant Platform.
Restricted Access
Access to certain areas, services, materials or functions of a Platform may be restricted.
GK Dutta reserves the right to restrict access to any area, feature, service, Content or, where necessary, the entire Platform at its discretion and subject to applicable law.
Where GK Dutta provides a User ID, password or other access credential for restricted areas, the User must keep such credentials confidential and must not disclose them to unauthorised persons.
GK Dutta may disable or terminate any User ID, password or access credential where it considers such action necessary, including in cases involving suspected misuse, security concerns, violation of these Terms and Conditions or other legitimate reasons.
User Content
For the purposes of these Terms and Conditions, “User Content” means material, including but not limited to text, images, photographs, audio, video and audiovisual material, that a User submits, uploads, posts, transmits or otherwise provides through a Platform.
By submitting User Content to a Platform, you grant GK Dutta a worldwide, non-exclusive, royalty-free licence, to the extent permitted by applicable law, to use, reproduce, adapt, publish, translate, distribute, display and otherwise use such User Content in connection with the operation, promotion, administration and development of the Platforms.
Where legally permissible, you also grant GK Dutta the right to authorise or sub-license such uses to service providers or other persons acting on behalf of GK Dutta.
You represent and warrant that:
- You own or otherwise have sufficient rights to submit the User Content;
- Your User Content does not infringe the intellectual-property rights, privacy rights, publicity rights or other legal rights of any third party;
- Your User Content is not unlawful or fraudulent;
- Your User Content does not contain malicious software;
- Your User Content is not defamatory, obscene, threatening or otherwise unlawful; and
- Your User Content will not expose GK Dutta or any third party to unlawful liability.
You must not submit User Content that is or has been the subject of threatened or actual legal proceedings or a similar complaint where such submission would create unlawful risk or violate the rights of another person.
GK Dutta reserves the right to edit, moderate, restrict, refuse, remove or delete User Content submitted to or stored on a Platform.
GK Dutta is not obliged to continuously monitor User Content unless required by applicable law.
Comments and Public Areas
By posting comments, messages, photographs, materials or other Content on GK Dutta websites, blogs or social-media platforms, you grant GK Dutta a non-exclusive, perpetual, worldwide, royalty-free licence, to the extent permitted by law, to use, reproduce, modify, adapt, translate, publish, distribute and display such Content in connection with the Platforms.
If you do not wish to grant these rights, you should not post or submit the relevant Content.
You must use comment forms, public areas, communication facilities and other interactive features only for their intended purposes.
You must not post or submit:
- Illegal or unlawful material;
- Defamatory material;
- Obscene material;
- Threatening or offensive material;
- Harmful or abusive material;
- Vulgar or otherwise objectionable material;
- Material that infringes another person's legal rights;
- Malicious software or harmful code;
- Material that falsely represents an affiliation with GK Dutta; or
- Material that may expose GK Dutta or another person to legal liability.
Where a particular Platform requires or permits participation by persons below 18, appropriate parental or guardian permission should be obtained where required by law or the relevant Platform's rules.
Mr. Gopika Kanta Dutta reserves the right to delete, remove, restrict, suspend or discontinue any Public Area or any Content posted therein, without prior notice where permitted by law.

No Warranties
The Platforms and their Content are provided “as is” and, to the maximum extent permitted by applicable law, without representations or warranties, express or implied.
GK Dutta does not represent or warrant that:
- Any Platform will be continuously available;
- Any Platform will be free from errors or interruptions;
- Content will always be complete;
- Content will always be true or accurate;
- Content will always be current or up to date;
- Any Platform will be free from security vulnerabilities; or
- Use of any Platform will satisfy every User's individual requirements.
Nothing contained on any Platform constitutes or is intended to constitute professional advice unless expressly stated otherwise.
Information relating to legal, financial, medical or other professional matters should not be treated as a substitute for advice from an appropriately qualified professional.
Limitations of Liability
To the maximum extent permitted by applicable law, GK Dutta shall not be liable to any User in relation to the Content of, use of, inability to use, or otherwise in connection with any Platform for:
- Direct losses arising from the free provision of a Platform;
- Indirect losses;
- Special losses;
- Consequential losses;
- Loss of business;
- Loss of revenue;
- Loss of income;
- Loss of profits;
- Loss of anticipated savings;
- Loss of contracts or business relationships;
- Loss of reputation or goodwill; or
- Loss, corruption or destruction of information or data.
These limitations shall apply to the maximum extent permitted by applicable law, even where GK Dutta has been advised of the possibility of such losses.
Nothing in these Terms and Conditions is intended to exclude liability that cannot lawfully be excluded or limited under applicable law.
Exceptions
Nothing in these Terms and Conditions shall exclude or limit any warranty, condition, right or liability that cannot lawfully be excluded or limited.
Nothing in these Terms and Conditions shall exclude or limit liability in respect of:
- Death or personal injury caused by negligence where such exclusion or limitation is prohibited by law;
- Fraud or fraudulent misrepresentation;
- Any matter that it would be unlawful or illegal to exclude or limit; or
- Any other liability that cannot legally be excluded or limited.
Reasonableness
By using a Platform, you acknowledge that the exclusions and limitations of liability contained in these Terms and Conditions are intended to operate only to the extent permitted by applicable law.
Other Parties
To the extent permitted by applicable law, you acknowledge that persons acting on behalf of GK Dutta, including authorised officers, employees, agents, representatives, contractors, service providers, affiliates, successors, assigns and other authorised persons, may rely upon the applicable limitations, exclusions and protections contained in these Terms and Conditions.
Nothing in this section shall exclude or limit any liability that cannot lawfully be excluded or limited.
Unenforceable Provisions
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable under applicable law, that provision shall be enforced to the maximum extent permitted by law or, where necessary, treated as severed from these Terms and Conditions.
The remaining provisions shall continue in full force and effect.
Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless GK Dutta and the persons authorised to act on his behalf against losses, damages, costs, liabilities and reasonable expenses, including reasonable legal expenses, arising from:
- Your breach of these Terms and Conditions;
- Your unlawful or improper use of any Platform;
- Your User Content;
- Your infringement of the rights of any third party; or
- Any claim that your conduct or User Content violated these Terms and Conditions or applicable law.
This provision shall apply only to the extent permitted by applicable law.
Breaches of These Terms and Conditions
Without prejudice to any other rights or remedies available under these Terms and Conditions or applicable law, if you breach these Terms and Conditions, GK Dutta may take appropriate action, including:
- Suspending or terminating your access;
- Restricting your access to specific Platform features;
- Removing or disabling User Content;
- Blocking access from particular accounts or technical sources;
- Reporting unlawful or abusive conduct to the relevant authority or platform operator;
- Contacting an internet service provider where appropriate and lawful; and/or
- Taking legal proceedings or other lawful action.
Any action taken shall be subject to applicable law.
Variation
GK Dutta may revise, amend, update or replace these Terms and Conditions from time to time.
Any revised Terms and Conditions shall become applicable from the date of publication or from any other effective date specified in the revised version.
Users are responsible for reviewing the applicable Terms and Conditions periodically to remain informed of the current version.
Assignment
To the extent permitted by applicable law, GK Dutta may transfer, assign, subcontract or otherwise deal with its rights and/or obligations under these Terms and Conditions without obtaining the User's prior consent.
You may not assign, transfer, subcontract or otherwise deal with your rights or obligations under these Terms and Conditions without the prior written consent of GK Dutta, except where such restriction is prohibited by applicable law.
Severability
If any provision of these Terms and Conditions is determined by a court or other competent authority to be unlawful, invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Where an unlawful or unenforceable provision could become lawful or enforceable by deleting part of it, that part shall be deemed deleted to the minimum extent necessary, and the remainder of the provision shall continue in effect.
Entire Agreement
These Terms and Conditions, together with any policies, notices and additional terms expressly incorporated by reference, constitute the agreement between you and GK Dutta concerning your use of the applicable Platforms.
They supersede previous terms, agreements, understandings or arrangements concerning the same subject matter, to the extent permitted by applicable law.
Law and Jurisdiction
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India.
Any dispute, controversy or difference arising out of or relating to these Terms and Conditions or the use of the Platforms shall, wherever legally permissible, be subject to the applicable dispute-resolution and jurisdiction provisions.
Where arbitration is applicable and legally permissible, the dispute may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time.
The place/seat of arbitration, appointment of the arbitrator, procedure and jurisdiction shall be determined in accordance with applicable law and any valid written agreement between the parties.
Subject to the foregoing and applicable law, courts having competent jurisdiction in Tripura, India, shall have jurisdiction over disputes arising in connection with these Terms and Conditions.
Registrations and Authorisations
GK Dutta may maintain registrations, authorisations, professional affiliations, intellectual-property registrations, tax registrations or other legal or regulatory registrations as may be applicable from time to time.
Where any registration, authorisation, professional affiliation or regulatory status is specifically represented on a Platform, such representation shall be understood according to the actual status of the relevant registration, authorisation or affiliation.
Nothing in these Terms and Conditions shall be interpreted as creating or representing a registration, licence, authorisation, professional qualification, supervisory relationship or regulatory status that does not legally exist.
Where applicable, relevant registration or identification details may be published separately on the relevant Platform.
